The Netherlands follows the EU eIDAS regulation. Electronic signatures are legally recognised as long as you choose the right type for the document.
Short answer
Electronic signatures are recognised in the EU under eIDAS. The legal effect depends on the type. A simple electronic signature is not automatically the same as a handwritten signature, and it is not an advanced or qualified signature.
When is it sufficient?
For many freelancer contracts, quotes and NDAs a simple electronic signature can be enough. SmartWerk stores a drawn signature, a server timestamp and technical details such as IP address and browser. It does not verify identity, use DigiD, or create a qualified signature.
When do you need more?
Real estate, notarial deeds and some government forms often need a qualified electronic signature, with a qualified certificate from a trusted provider. DigiD is not a qualified electronic signature.
Best practices
Keep the signed PDF together with the timestamp and the details the platform records. SmartWerk does not verify who the signer is in person.
Three kinds of electronic signature
eIDAS distinguishes simple, advanced and qualified electronic signatures. The higher the level, the stronger the link to the signer and the heavier the evidence. Which you need depends on the document and the risk.
What to look for when choosing a solution
Check that the tool stores timestamps, a clear audit log and an unchangeable PDF. Ask yourself whether you can still trace the signer later, and whether the signing party understands the nature of the document before they sign.
A clear workflow for freelancers
Send the contract in advance, let the client read it calmly and then sign digitally. Keep the signed PDF together with the related data, and state in your terms that digital signing is permitted.
Frequently asked questions
Is a scanned signature valid?
A scanned signature pasted into a document is weak evidence. Prefer a solution that records time, data and a log.
Is agreeing by email also valid?
An email in which someone agrees can serve as evidence but is weaker than a recorded signature. For important agreements choose a clear digital signature.
Do I need DigiD to sign?
No. DigiD is a login method, not a qualified electronic signature. For most freelancer contracts it isn't needed.
How long should I keep a signed contract?
As a rule keep contracts and related data for at least seven years, or longer if the assignment or legislation requires it.
